Summit & Vines Moto Tours – Terms and Conditions

1. Introduction
1.1 These Terms and Conditions govern the contractual relationship between Summit & Vines Moto Tours ("we", "our", "us") and the participant ("you", "your"). By booking a tour with us, you agree to be bound by these Terms and Conditions. 1.2 We operate in compliance with applicable UK and European laws governing tour operations, consumer rights, health and safety, and road traffic regulations.

2. Booking and Payment
2.1 A deposit of 25% of the total tour cost is required to secure a booking. The remaining balance must be paid no later than 60 days before the tour start date. 2.2 If a booking is made within 60 days of departure, full payment is required at the time of booking. 2.3 Payments can be made via bank transfer, debit/credit card, or other approved methods. 2.4 Failure to make full payment on time may result in cancellation without a refund.

3. Cancellation and Refund Policy
3.1 Cancellations by the participant must be made in writing. Refunds are as follows:

  • More than 60 days before departure: Full refund minus administrative fees.

  • 30-59 days before departure: 50% refund.

  • Less than 30 days before departure: No refund. 3.2 We reserve the right to cancel a tour due to unforeseen circumstances. If we cancel, participants will receive a full refund or an alternative tour option.

4. Participant Requirements and Responsibilities
4.1 Participants must hold a valid motorcycle licence suitable for the tour destinations. 4.2 Participants must have valid motorcycle insurance, including cover for personal injury and third-party liability. 4.3 You must ensure your motorcycle is roadworthy and complies with local laws. 4.4 Participants must comply with local road traffic regulations and follow tour guide instructions at all times. 4.5 You must notify us of any medical conditions that could affect your ability to participate in the tour.

5. Health and Safety
5.1 Participants must wear approved motorcycle protective gear, including a helmet that meets EU/UK safety standards. 5.2 Alcohol and drug consumption before or during riding is strictly prohibited. 5.3 We reserve the right to remove any participant from a tour if their behaviour poses a risk to themselves or others. 5.4 We comply with UK and EU health and safety regulations to ensure a safe touring environment. 5.5 In the event of an accident, emergency procedures will be followed, and participants must adhere to safety briefings.

6. Liability and Insurance
6.1 We are not liable for any personal injury, damage, loss, or theft of property unless caused by our proven negligence. 6.2 Participants are responsible for their own travel and health insurance covering motorcycle touring. 6.3 We are not responsible for any travel disruptions, delays, or cancellations beyond our control.

7. Force Majeure
7.1 We are not liable for any failure or delay in performance due to events beyond our control, including but not limited to natural disasters, pandemics, civil unrest, or legal restrictions.

8. Data Protection and Privacy
8.1 We comply with the UK Data Protection Act 2018 and the EU General Data Protection Regulation (GDPR). 8.2 Personal data collected during booking will be used solely for tour administration and will not be shared with third parties without consent.

9. Governing Law and Jurisdiction
9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. 9.2 Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Amendments
10.1 We reserve the right to amend these Terms and Conditions at any time. Participants will be notified of any significant changes before their tour departure.

By booking a tour with Summit & Vines Moto Tours, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Summit & Vines engagement agreement

1.Summit & Vines Moto Tours is committed to ensuring a safe, enjoyable, and responsible riding experience for all participants. This agreement outlines the expectations for sensible riding and the support provided by our team to promote safety, respect, and enjoyment for everyone involved.

2. Rider Responsibilities By participating in a Summit & Vines Moto Tour, all riders agree to adhere to the following sensible riding principles:

  • Compliance with Laws: Riders must obey all local traffic laws, speed limits, and regulations at all times.

  • Defensive Riding: Riders must maintain situational awareness, anticipate hazards, and exercise caution in all riding conditions.

  • Respect for Fellow Riders: Riders must maintain a safe distance, avoid aggressive riding behaviours, and communicate effectively with the group.

  • Environmental Responsibility: Riders must respect nature, avoid littering, and adhere to designated routes to minimise environmental impact.

  • Fitness to Ride: Riders must be in good physical and mental condition to participate safely and must not ride under the influence of alcohol, drugs, or medications that impair abilities.

  • Bike Maintenance: Riders must ensure their motorcycles are in good working order before the tour and perform routine checks throughout the journey.

  • Personal Protective Equipment (PPE): Riders must wear appropriate safety gear, including a helmet, gloves, protective clothing, and suitable footwear.

  • European Breakdown Cover: Riders must have valid European breakdown cover for their motorcycle to ensure prompt assistance in case of mechanical failure.

 

3. Alcohol Consumption and Rest Periods Summit & Vines Moto Tours recognises that vineyard visits may involve alcohol tasting. To ensure safety and compliance with responsible riding practices, the following rules apply:

  • Riders must not consume alcohol beyond responsible tasting levels during vineyard visits.

  • A minimum rest period of 12 hours must be observed between alcohol consumption and resuming riding.

  • Any rider deemed unfit to ride due to alcohol consumption will not be permitted to continue until they meet the required rest period and are deemed safe to ride by tour guides.

  • Riders are responsible for self-monitoring and adhering to these guidelines to ensure their own safety and the safety of others.

4. Support Provided by Summit & Vines Moto Tours To facilitate a safe and enjoyable experience, Summit & Vines Moto Tours provides the following support:

  • Pre-Tour Briefing: Riders will receive a detailed safety briefing covering route details, riding conditions, and group protocols.

  • Experienced Guides: Professional tour leaders will oversee group safety, provide assistance, and enforce riding standards.

  • Emergency Assistance: A designated support team will be available to assist in case of breakdowns, medical emergencies, or unforeseen challenges.

  • Communication Systems: Riders will have access to communication channels to stay connected with guides and fellow participants.

  • Pacing and Rest Breaks: Regular stops will be scheduled to ensure rider well-being and prevent fatigue.
